SA State Nomination 491/190 - If I Am Not Working In My Nominated Occupation, Am I Eligible For Visa 190 or Visa 491?

Can I be eligible for state nomination (491/190) from Migration SA if I am not working in my nominated occupation?

South Australia Visa 491/190 program is one of the most generous program in Australia. There are plenty of allocations for Skilled visa 491 and 190 in South Australia comparing to the small number of international students and workers here.

Therefore, South Australia has many streams for skilled migrants (the highest number of migration streams available among all states and territories).

Know the complicating of South Australia Skilled Visa 491 and 190 nomination streams, we are writing this blog for someone who is seeking permanent residency pathway when you are not working in your nominated occupation or if you are from Melbourne or Sydney and not confident to get your nominated job in South Australia.

A common question that we have been asked many times is:

"How can I get 491 or 190 state nominations from SA if I am working as an Aged Care Worker or a Disability Care Worker, whereas my nominated occupation is totally different such as Accountant or ICT related? "


Work Experience Exemption streams in South Australia State Nomination 491 visa and 190 Visa Available

Usually, to get state nomination for a General Skilled Migration visa, there is a requirement of work experience in the nominated occupation or in any closely related field.

SA is even providing a more generous definition of closely related occupation.

They do not use the first 4 digits of ANZSCO code to determine closely related. They expand the list by accepting first 2 digits or even all occupations in the same skill assessing authority will be counted as closely related occupation.

However, it varies between each occupation. We highly recommend you look up your own occupation on the website to check your closely related options.

For skilled migrants who are not able to find a job or who are working in Aged Care or Disability sector that is not related to their major, these streams are perfectly fit for your Australian Permanent Residency purpose.

Migration SA provides exemptions  for people who are living and working in outer regional South Australia or for people who are long term residents of SA.

Here are some of the exemptions you might be interested in:

 

  • Exemptions for applicants living and working in OUTER REGIONAL SOUTH AUSTRALIA in any occupation

Outer Regional SA Visa 491 and 190 Work Experience Exemption

There are certain concessions to work experience requirements if you are living and working in outer regional of South Australia.

According to this stream, Applicants living and working in outer regional South Australia for the last 12 months in any occupation (does not have to be a skilled occupation nor related to your nominated occupation) may be eligible to be nominated for a 491-visa nomination

Applicants living and working for the last 24 months in outer regional South Australia in any occupation, may be eligible to be nominated for 190 visa nomination

To be considered eligible for this stream, you must be currently living and working in SA Regional areas. 

What to be considered before apply for living and working in outer regional of South Australia Visa 491 and 190?

Missing one of those requirement will not be eligible for visa 491 or 190 in South Australia State Nomination.

If you are working remotely and currently living in outer regional of South Australia, it may not be counted as being eligible for the stream.

If you are studying in Greater Adelaide Area and living in outer regional of South Australia, you may not be eligible for the 491 or 190 nomination in SA.

Lower skilled occupations like cleaners, waitors and waitresses ARE ELIGIBLE as long as you are earning taxable income from a company in Regional of South Australia.

  • Exemptions for international graduates of SA or their partners who are living and working in SA (including Greater Adelaide) as a long-term resident/s:

This may be a good option for applicants who have finished their studies from SA and are living and working in SA (including greater Adelaide) being long term residents of SA.

Under these exemptions, you may be eligible for subclass 491 nomination, if you have been living in SA for the last 3 years and you are working in SA for the last 12 months in a skilled occupation that is not your nominated occupation, including all Skill Level 1, 2, 3 occupations and Skill Level 4 Carers and Aides occupations.

For many graduates, they must have been in Adelaide for at least 2 years plus their temporary graduate visa 485  or Post study Work 485 Visa (These are 2 different streams under Subclass 485 Visa). Attaining 3 years of living and working in South Australia is so straightforward.

Those who are studying or complete their study in Accounting, ICT Major, Social Work, Community Work or Engineering in Australia will take the most advantage from long term resident SA 491 stream. 

With those students, they may at least be eligible for 491 if they work as aged care workers or disability support worker in South Australia for State Nomination Visa 491.

Please be mindful that lower skilled occupations such as cleaners, waitors or waitresses, kitchenhands are NOT eligible for the stream.

  • Work Exemptions for temporary visa holders residing in SA for 5 years:

You may be eligible for 491 nomination if you are residing in SA (including greater Adelaide) from last 5 years are currently working for the last 12 months in SA in a skilled occupation that is not your nominated occupation, including all Skill Level 1, 2, 3 occupations and Skill Level 4 Carers and Aides occupations.

Lower skilled occupations are not eligible

Not all the occupations have these exemptions available. We recommend that you check the requirements for your nominated occupation on SA Migration website before applying.

Who gets the benefit of SA nomination streams for Visa 491 and Visa 190?

Some of the occupations including Accountants and ICT related occupations, Social work, Community work or Engineering professionals are taking the most advantage of those streams above.

Those are courses that can get skill assessment immediately post-qualification without requirement of work experience canhave a lot of benefit of these streams in South Australia.

Especially, for international students interstate such as Melbourne or Sydney, you only need at least 12 months to apply for 491 visa or 24 months for 190 visa in South Australia Outer regional Area.

You may have a lot of work experience in Aged Care or Disability support, good time, South Australia is facing a severe shortage in health care sector in which having plenty of vacancies.

No matter who you are, where you studied or completed your study, South Australia always have an option for you to secure your Permanent Residency Pathway.

Immigration SA to close online state nomination application system on 25 June!

Key terms: Subclass 190 Skilled Nominated visa – Subclass 489 Skilled Regional Sponsored visa – Immigration SA – State Nomination – End of Financial Year 2018

Immigration SA (South Australia) has announced that the online application system for the subclass 190 State Nominated Visa and subclass 489 Skilled Regional Sponsored Visa (State) nominations for South Australia will close at 9 a.m. Monday, 25 June 2018 (South Australian time).

If you do not submit and pay for the SA State Nomination application before the system closure, the incomplete application will be deleted.

You are advised to submit your SA state nomination application before the system closure, so that you are protected from any possible new changes on 1 July 2018.

However do note that you should only submit complete and well supported applications, to allow smooth processing of your application and a positive outcome.

State sponsorship is a critical component of the Australian visa application for many. Having a state nominated visa application provides:

  • an immediate Invitation to Apply (ITA) for the subclass 190 Skilled Nominated and subclass 489 Skilled Regional Sponsored visas, i.e. not subject to invitation round points requirements
  • access to additional occupations on the Short-term Skilled Occupation List (STSOL) - each Australian State and Territory creates their own list from the STSOL)

Typically there are limited places for each occupation being sponsored by the different States and Territories. The best time to apply is in early July (NOW) as the planning numbers are reset for the new financial year.

South Australia State Nomination Occupation List (SNOL) now available!

Immigration SA has released the new State Nomination Occupation List (SNOL) for 2016-17. You can look at the occupations available for nomination here.

A quick glance at the new occupation list shows the following:

- Finance Managers, Accountants (on Supplementary Skilled List) showing high availability for now

- ICT occupations require 70 points to be eligible for state nomination

- Café or Restaurant Manager is only suitable for subclass 489 Skilled Regional Sponsored visa sponsorship

- Customer Service Manager also only available for subclass 489 Skilled Regional Sponsored visa sponsorship

- Registered Nurse shows high availability

- Enrolled Nurse only eligible for subclass 489 Skilled Regional Sponsored Visa sponsorship

- Baker, Pastry Chef, Chef and Cook only eligible for subclass 489 Skilled Regional Sponsored Visa sponsorship

- Marketing Specialist and other generic business professionals listed as High Availability on the Supplementary Skilled List

Immigration SA may only accept a limited number of applicants for each occupation. You are advised to secure your nomination as soon as possible while there is still high availability.

The following has recently been announced by Migration and Information Services section of the ACT Government.

Skilled Nominated (subclass 190) visa – Closure of ACT nomination program to overseas applicants for 2015/16

Effective immediately (18 March 2016 at 4pm AEST) - The ACT Migration program is closed to all overseas residents. If your client is not in Australia, you will not be able to apply for ACT nomination of a Skilled Nominated (subclass 190) visa until the program reopens on 1 July 2016.

Applications for ACT nomination submitted before 4pm today will still be processed in queue order.

Please note, the current processing time is 3 - 4 months due to the large number of applications received post publication of the February 23 Occupation List.

CANBERRA RESIDENTS

This action does not affect Canberra based applicants. If your client is living in Canberra the 190 ACT nomination program is still open if they meet the nomination criteria. The average processing time of applications from Canberra residents is 4 weeks.”

This closure of the list announced by the ACT government is probably just the first of a number of similar actions by States and Territories.   The migration program year runs from the 1 July to the 30 June each year.

The states have a limited numbers of positions to nominate and they also try to set their own internal target in relation to different occupations.  As the end of the migration program year approached, and we get closer to the 30 June 2016, the state and territories may run out of positions to nominate.

The positive side of the cycle, is that the states will have new quotas of position to nominated from the 1 July 2016. So it is often still worth while for you to get your skills assessed and to achieve the required English scores, with a view to the new lists.

Immigration SA, the South Australia state department which manages state nomination policies and processes state nomination applications, has introduced a new nomination option for international graduates who studied in South Australian public universities.

What is a High Performing Graduate?

According to Immigration SA, you can claim to be a High Performing Graduate for SA state nomination by meeting ALL of the following requirements:

  • Currently residing in South Australia
  • Studied at a South Australian public university, which includes:
    • Flinders University
    • University of Adelaide
    • University of South Australia
  • Completed one of the following qualifications:
    • PhD
    • Masters by Research
    • GPA of 6.0 or above in a Masters by Coursework degree (following completion of a Bachelor degree in South Australia)
    • First Class Honours in a dedicated Honours year (following completion of a Bachelor degree in South Australia)
    • GPA of 6.0 or above in a Bachelor degree

Note: GPA – Grade Point Average

What is the benefit of obtaining the state nomination via the High Performing Graduate pathway?

Benefits in seeking state nomination via the High Performing Graduate stream include the following:

(Additional 5 points for subclass 190; additional 10 points for subclass 489)

  • Access to a more extensive list of occupations on either the State Occupation List or the Supplementary Skilled List, including nominating occupations where “Special Conditions Apply”
  • Obtain waivers for Immigration SA’s work experience and English language requirements

South Australia has done it again. Previously the Immigration SA team introduced the High Points sponsorship option, to attract high calibre migrants for state sponsorship. With the introduction of the High Performing Graduate sponsorship pathway, it is expected that more General Skilled Migration applicants will be making South Australia their home. The additional sponsorship pathway is definitely welcomed among international graduates to seek extra points and waivers for their visa application.

Policies like this also make SA a more attractive place for International Studies. High achieving students may choose to study in SA due to the favourable state nomination requirements provided by Immigration SA for SA international graduates.

While the High Performing Graduate sponsorship option is available for graduates of the 3 public universities listed, SA international graduates from other institutes with excellent academic records can still seek SA nomination by sending their academic transcript to Immigration SA for consideration on a case-by-case basis. You should seek Immigration SA opinion if you have excellent grades.

You should also note that there are other criteria that need to be fulfilled, such as obtaining sufficient points in the Expression of Interest (EOI), meeting health and character requirements, and so on.

Australian SkillSelect Round Results September/August 2018 - Skilled Independent & Regional Visa Occupation Lists

 

Since 1 July 2015, Immigration South Australia (SA) has implemented a Supplementary Skilled List in addition to the normal State Occupation List as part of its state sponsorship programme. The Supplementary Skilled List includes all occupations that are not on the SA State Occupation List but are on the Federal Consolidated Skilled Occupational List (CSOL). Some of the occupations that can be accessed on the Supplementary Skilled List include:

  • Generic business professionals such as Marketing, Advertising and HR professionals – Marketing Specialists, Marketing Managers, Recruitment Consultants, Commodities Traders
  • Management Consultants and Policy Analysts
  • Sales Representatives – Medical, ICT or Industrial
  • Education professionals for example Lecturers, primary and secondary School Teachers
  • Engineering Technicians
  • Tradesworkers – Toolmakers, Florists, Sound Technicians, Interior Decorators, etc.

Who will benefit from the South Australia Supplementary Skilled List?

The SA Supplementary Skilled List is helpful for the following people:

  • Applicants with occupations that are not suitable for a Skilled-Independent Subclass 189 visa, i.e. the nominated occupation is not on the Federal Skilled Occupation List (SOL)
  • The applicant’s nominated occupation does not have a state or territory available to sponsor for a Skilled Sponsored Subclass 190 visa or a Skilled Regional Sponsored Subclass 489 visa

That is great! How can I access the South Australia Supplementary Skilled List?

An applicant can access the Supplementary Skilled List if they can meet one of the following conditions:

Is it possible to accumulate 80 points for the Skilled Migration Points Test?

Typically most skilled applications claim 60 to 70 points for their applications. To claim 80 points applicants are likely to have Superior English ability, age between 25 and 32 years and have Australian studies or a PhD. Here is an example:

As demonstrated above it is possible to achieve the 80 points required with some room for manoeuvre.

At a recent meeting with Immigration SA, it was interesting to find out that there were a lot of applications submitted for the Supplementary Skilled List occupations under the claims for 80 points or more. As the only state sponsorship authority willing to consider all occupations on the CSOL, it is not surprising that many applicants now flock towards SA to obtain state sponsorship. However, applicants should thoroughly check and make sure that they can meet the points claimed to ensure a successful state sponsorship application.

Applicants should also consider the other criteria to access the Supplementary Skilled List. The current South Australian employment and chain migration criteria will definitely be useful for temporary overseas workers in SA and the relatives of Australian permanent residents in SA.

If the large numbers of applications submitted to Immigration SA thus far are all eligible, we might see Immigration SA suspend certain occupations for state sponsorship as some of the occupations will hit the state planning numbers for the fiscal year. More news in relation to the Australian migration programme in the new fiscal year! Here is an overview:

  • Immigration SA is the first to release its Occupation Lists for State Sponsorship
  • Amendments to the SOL and the CSOL (Dentists and Urban Planners take note)
  • Austrade becomes a nominator for the SIV programme

Immigration SA releases Occupation List

Immigration South Australia has published their occupation lists and will be accepting applications for state sponsorship on the 6 July 2015. All occupations are now listed as “High Availability” but it is expected that places for popular occupations will be filled up very quickly, especially since no other state or territory has published a new list of occupations for sponsorship. Here is a highlight of the SA occupation list:

  • All ICT occupations are available for sponsorship
  • Registered Nurses (nec), Enrolled Nurses and Mothercraft Nurses are available for sponsorship
  • Mining and Oil & Gas occupations are not on the list
  • Applicants who register 80 points or higher in the Skillselect pool can now access the Supplementary Skilled List

A reminder that Immigration SA now charges for processing a state sponsorship application. Read up in our previous news post about the fees applicable here. There are also updates to the English requirements.

On a separate note ACT (Canberra) will announce their occupation list in August 2015.

Amendments to the Skilled Occupation List (SOL) and Consolidated Skilled Occupation List (CSOL)

There have been amendments to the SOL and CSOL, specifically:

  • Urban & Regional Planners, Dental Specialist and Dentists are removed from the SOL and moved to the CSOL – this means that these occupations now require state sponsorship
  • Panelbeater and Cabinetmaker are removed from the CSOL and moved to the SOL
  • Primary School Teacher is removed from the CSOL

Austrade becomes a Nominator for the Significant Investor Visa (SIV)

In addition to the Australian states and territories Austrade is now a nominator for the SIV programme. The application fee for nomination is A$ 1000 which is significantly higher than other states and territories. However applicants nominated by Austrade will be allowed to settle down in any part of Australia.

Immigration SA is taking the lead in receiving new applications for state sponsorship in the new fiscal year. However the allocation numbers for SA are usually low so expect places to be filled up quickly. You should apply as soon as possible on the 6 July 2015. The new role of Austrade as a SIV nominator is also beneficial for applicants who do not have a preferred location for settlement as they will not be geographically restricted.

Immigration SA has published a list of upcoming changes for the new financial year 2014-15. Here are the pending changes that will come into effect on 1 July 2015:

1) New State Occupation List

Applicants looking for South Australia state sponsorship will have to refer to the new occupation list on 1 July to determine eligibility and additional requirements.

2) New English Requirements

ICT occupations now need to fulfil Proficient English or an overall score of Proficient Plus English.

Engineering occupations will need to meet Competent Plus English or an overall score of Proficient English.

There will also be changes to other occupations so you will need to check the new occupation list to find out occupation-specific requirements.

3) Closure of the Online Application System

The SA application system for the 190 and 489 state sponsorship will be closed at 1 p.m. (Adelaide time) on 30 June 2015. The system will only re-open at 12 p.m. on 1 July 2015. All applications that are saved or submitted WITHOUT PAYMENT will be deleted and you will need to lodge new applications. Applications submitted on 1 July 2015 or after will be subject to new state sponsorship requirements.

It is beneficial that Immigration SA has released a list of changes (although not complete) that will be in effect on 1 July 2015. This serves as a reminder to all who are looking to obtain SA state sponsorship to complete their applications and submit payment before the closure of the system. As there may be a rush for submissions near the closure, you are advised to complete the submission as early as possible before the closure date.

The new financial year for Australia is coming and here are some migration related news you need to know.

  • Visa Application Fees (VAC) are increasing on 1 July 2015
  • Immigration South Australia (SA) will start collecting fees on 10 June 2015
  • Changes to the Significant Investor Visa (SIV) and introduction of the Premium Investor Visa (PIV)

 

Visa Application Charges for 1 July 2015

If you missed our earlier news entry on the VAC increments, click here to find out more. The new fees apply if you submit a visa application on 1 July 2015 or after, so you can still submit an application now to avoid the fee increase. The increase ranges from 2.3% to 50%.

A word of caution: try not to leave your application until the last day (30 June 2015) for submission. The online system may be flooded and users can experience system outages. A scheduled outage has been announced for Midnight Tuesday 30 June to 7am Wednesday 1 July 2015. ​

 

Immigration SA now charges fees for state sponsorship effective 10 June 2015

Immigration SA announced earlier that they will start collecting fees for state sponsorship application, following what other states and territories have been doing for a while now. Here is the breakdown of the charges:

Changes to the Significant Investor Visa (SIV) and announcing the Premium Investor Visa (PIV)

The SIV has been suspended since 24 April 2015, and will resume on 1 July 2015. While the investment amount of A$ 5 million has not changed, the structure of the complying investments has been modified to ensure allocation of investment funds to start-ups, instead of mainly government bonds. Here is the breakdown:

  • At least A$ 500,000 in eligible Australian venture capital or growth private equity fund(s) investing in start-up and small private companies (“VCPE”). The Government expects to increase this to A$ 1 million for new applications within two years as the market responds; 
  •  At least A$ 1.5 million in an eligible managed fund(s) or Listed Investment Companies (“LICs”) that invest in emerging companies listed on the Australian Securities Exchange (“ASX”); and 
  • A ‘balancing investment’ of up to A$ 3 million in managed fund(s) or LICs that invest in a combination of eligible assets that include other ASX listed companies, eligible corporate bonds or notes, annuities and real property (subject to the 10 per cent limit on residential real estate). 

For the new PIV, a minimum investment of A$ 15 million will be required. It will be available at the invitation of the Australian Government only, with potential applicants to be nominated by Austrade. The investor will be able to apply for permanent residence in 12 months’ time, compared to 4 years for the SIV.

The new financial year usually brings Visa Application Charge (VAC) increases and changes to the visa programme. The best mentality for Australian visa applications is to submit an application when you are eligible as soon as possible. Do not put yourself and your family at risk of fee increases (which may be significant if you are from overseas) and migration legislation changes. Act now and lodge your application as soon as possible.

The South Australia Supplementary Skilled List provides more options for State Sponsorship

Immigration SA has announced the South Australian Supplementary Skilled List today which replaces the Graduate List. The Supplementary Skilled List contains 480 occupations, many of which that are not on the State Occupation List. The Supplementary Skilled List allows more occupations and different skilled workers to be sponsored by the South Australian state government. Applicants can access the Supplementary Skilled List if they:

  • graduated from studies in a South Australian education institute with at least one academic year of study
  • worked in a skilled occupation in South Australia for at least 12 months
  • have a immediate family member (permanent resident or Australian citizen) who has resided in South Australia for 12 months or more

You must still meet the state nomination requirements for factors such as age, skills assessment, work experience, English and financial capacity. For further information please visit the Immigration SA website.

New Fees Applicable for Immigration SA State Sponsorship Applications

Immigration SA has announced that there will be fees chargeable for SA state sponsorship applications starting possibly as soon as 16 March 2015. Below is the email notification sent by Immigration SA:

As you know, migrants play an integral part in growing South Australia’s economy, by boosting productivity and strengthening our skills base.

To help ensure continued improvement in the assessment of applications, Immigration SA will introduce application fees later this year for both skilled and business State nomination applications.  We believe the introduction of fees will reduce the number of non-genuine applications, including duplications which slow processing times.

Immigration SA encourages prospective migrants to submit applications before application fees are introduced. Fees will come into effect after 15 March 2015. The actual implementation date will be confirmed as soon as possible.

It seems to be a regrettable trend that DIBP and State agencies are raising their fees.

In the short term, one response to the Immigration SA fees could be to try to lodge an application before the fees come into play, after the 15 March 2015.

Immigration SA announces changes to provide visa options for Vocational, Educational and Training graduates – good news for Enrolled Nurses, Cooks and more

South Australian International Vocational, Education and Training (VET) Graduates now considered for State Nominations

 

Effective from 23 December 2014, Immigration SA is including VET graduates as part of the state sponsorship programme for skilled migration visas subclass 190 and 489.  To be eligible VET graduates of South Australia will need to be:

  • Currently working for 12 months or more in their nominated or closely related occupation in South Australia (minimum 20 hours per week); OR
  • Currently working for 6 months or more in their nominated or closely related occupation in a country region of South Australia (minimum 20 hours per week). The country region must be outside of Greater Adelaide.

The country region of South Australia is defined by postcode and you can explore the country regions on the Immigration SA website here.

What does this mean for you?

General Skilled Migration 190/489 - South Australian State nomination made easier for UK Canada NZ US and Rep of Ireland

 

Immigration SA has made it easier for citizens and current passport holders of exempt countries to apply for South Australian state nomination.

Exempt Countries include:

United Kingdom
Canada
New Zealand
United States of America
Republic of Ireland

If you are a citizen or passport holder of one of the listed exempt countries, you no longer need to provide an English test result (IELTS or OET) to Immigration SA regardless of Immigration SA’s English requirement for your occupation.

If you are an International Graduate of South Australia and a citizen or passport holder of one of the listed exempt countries, you can also access the Immigration SA work experience waiver for ‘available’ occupations. See point eight under eligibility requirements for information on how to qualify for a work experience waiver.

Please note you may still require an IELTS or OET to gain additional points on the Department of Immigration and Border Protection (DIBP) points test. Additionally Skills Assessing Authorities and Registration / Licensing bodies in South Australia have their own English / work experience requirements so people from exempt countries need to ensure they can meet those requirements prior to applying for state nomination.

The major changes to the SA nomination process are detailed below:

Additions to the South Australian State Occupation List


The new occupation lists for the 2014/15 program year are available on our website.  Below are some of the occupations that have been added to the State Occupation List:

  • Advertising Manager
  • Public Relations Manager
  • Regional Education Manager
  • Vocational Education Teacher (trades)
  • Vocational Education Teacher (non-trades)
  • Special needs teacher
  • Art Administrator or Manager
  • Nurse Practitioner
  • Finance Broker
  • Financial Investment Manager
  • Valuer

New Criteria Recognising an applicant’s commitment to South Australia:

  • Applicants who have worked in South Australia for the last 12 months in a skilled occupation* have access to a more extensive occupation list.  
  • Applicants with a Bachelor degree or higher can apply for occupations on the South Australian Graduate List. 
  • Applicants with a Vocational Education and Training (VET) qualification or higher can apply for occupations listed as “special conditions apply’ on the State Occupation List. 
  • Applicants must meet all other DIBP and Immigration South Australia criteria to qualify. 

*The skilled occupation must be ANZSCO level 1 to 4 and listed on the State Nominated Occupation Lists.

IELTS scores are brought into line with Department of Immigration and Border Protections requirements:

IELTS requirements (for most occupations) have been reduced to six in each band score to align with DIBP requirements. All score requirements are published on the State Occupation List.

Health Professionals and Education Professionals in South Australia require a minimum IELTS score of 7.0 in each band, or alternatively, for health professionals, OET B in each component.

For those who already have registration to practice in South Australia, you can apply with a minimum IELTS score of 6.0 in each band score. You must provide a copy of your registration certificate with your application.

Criteria for International Graduated of South Australia to access a Work Experience Waiver:

To access a work experience waiver, international graduates of South Australia need to meet following requirements: 

  • Work a minimum of 20 hours per week in a skilled occupation* in South Australia
  • OR 
  • Have an IELTS score of 7.5 overall or 7.0 in each band score
  • Have an occupation listed as ‘available’ on the state occupation list
  • Reside in South Australia.

PhD or Masters by Research graduates from South Australia can access a work experience waiver for occupations on either list – see the eligibility requirements for further details. 

*If an occupation requires additional work experience (e.g. two or three years or as stated on the South Australia Occupation Lists), international graduates of South Australia are still eligible to apply for state nomination if they are currently working 20 hours per week in South Australia in their nominated occupation or a closely related occupation.

Chain Migration a new pathway to an Australian skilled Visa

In July 2014 Immigration SA have announce a new state nominated option which is called ‘Chain Migration’.

Chain migration is a new pathway to gain South Australian sponsorship for a skilled visa.

Chain migration allows international graduated with Australian qualifications to apply for state nominated visas (489 or 190) if they have a relevant relative that is an Australian Citizen or PR that is settled in South Australia.

Here are the details from Immigration SA:

                The benefits of the chain migration pathway:

·         Ability to apply for a permanent (190) or provisional (489) visa

·         Access to a more extensive occupation list compared to the Department of Immigration and Border Protection's (DIBP) Skilled Occupation List (SOL)

·         Instant visa invitation from DIBP once approved for state nomination 

·         Priority visa processing with DIBP”

“Requirements


To qualify for the chain migration pathway, applicants must:

·  Have completed a Bachelor degree or higher

·  Meet all DIBP criteria and Immigration South Australia criteria

·  Have 60 points on the DIBP points test.

To qualify for the chain migration pathway, the family member in South Australia must: 

·  Be the applicant’s grandfather, grandmother, father, mother, brother or sister. Applicants can still apply if it’s a step or adoptive parent/sibling. 

·  Be an Australian Permanent Resident or an Australian Citizen

·  Have resided in South Australia for the past twelve months. “

Here are the requirements of Chain Migration as detailed on Immigration SA Website:

Chain Migration is a state nomination pathway for applicants who have an immediate family member permanently residing in South Australia.

12.1 Chain Migration applicants can apply for occupations listed as ‘Special conditions apply’ on the State Occupation List.

12.2 Chain migration applicants can apply for occupations that are listed on the South Australian Graduate List.

12.3 Chain Migration applicants who are international graduates of Australia (who meet the work experience requirement listed under point 7) can apply for a provisional (489) visa or permanent (190) visa for any occupation listed as ‘available’ on the State Occupation list.

12.4 The applicant needs to meet all DIBP and Immigration SA criteria.

12.5 The applicant must have completed a Bachelor degree or higher in the field of their nominated occupation.

12.6 The applicant’s immediate family member in South Australia must meet all criteria listed under 12.6 below.

12.6.1 The family member residing in South Australia must be the applicant’s grandfather, grandmother, father, mother, brother or sister. Applicants can still apply if it’s a step or adoptive parent / sibling.

12.6.2 The family member must be over 18 years of age.

12.6.3 The family member in South Australia must be either an Australian Permanent Resident or an Australian Citizen.

12.6.4 The family member must be currently residing in South Australia and have resided in South Australia for the last twelve months.

12.7 The Applicant’s family member in South Australia is required to complete a Statutory Declaration to confirm that they meet the all chain migration criteria.”

Commentary by Chris Johnston:

The Chain Migration pathway is a great new opportunity for many to apply for an Australian visa.

It should make for some interesting situations.

People with relatives already in SA will clearly be the first to use chain migration.

The Chain Migration pathway will also give more incentive for people outside of Australia, with family that have already migrated to South Australia, to choose to study in South Australia.

But the incentive of Chain migration could have wider results. If you have the points but cannot get state nomination anywhere in Australia then you may want to consider asking your Australian Citizen or PR family members to move to South Australia.  Once these Australian Citizen or PR family members have lived in South Australia for 12 months or more then you may be eligible for a Chain Migration sponsorship.

Immigration SA opportunity - provisional to permanent 190 visa - open from 14 May until 15 June 2014

Immigration SA has released the following information about State Nomination of provisional visa holders for the permanent subclass 190:

Permanent state nomination for South Australian provisional visa holders


From 14 May until 15 June 2014, people who hold a South Australian state nominated provisional visa (subclass 489, 475, 487 and 495 only), who are living and working in the state can apply for a 190 - Skilled Nominated Permanent visa through Immigration South Australia. 

This trial program enables people who have already secured a provisional state nominated visa to apply for a permanent visa through the same program.  

State nominated applications made under this program will be priority processed.  The program will run from 14 May until 15 June 2014 or until the nomination quota has been reached.
